Apple takes a USD 119M bite into Samsung while Android continues to grow in US

United States District Court in San Jose, California has declared that Samsung has infringed on some of Apple’s patents, and has asked it to pay USD 119,625,000 in damages to the latter. As reported by Verge, the number is really small as compared to USD 2.19 billion that Apple had initially demanded for five patent violations.

At the same time, the jury has also asked Apple to pay up USD 158,400 for infringing patent 449 of Samsung that involve a photo and video gallery feature, being used in iPhone versions 4, 4S and 5 & iPod Touch generations 4 & 5.

The 10 Samsung devices involved in the discussion, have a ‘Quick Links’ feature patented (Patent 647) by Apple. The feature makes phone numbers and email addresses clickable. Another patent infringement that has costed Samsung is the ‘slide to unlock’ (Patent 721) feature.

“We are grateful to the jury and the court for their service,” Apple told Re/code. “Today’s ruling reinforces what courts around the world have already found: That Samsung willfully stole our ideas and copied our products. We are fighting to defend the hard work that goes into beloved products like the iPhone, which our employees devote their lives to designing and delivering for our customers.”

This verdict might not be the end of the story, these patent wars seem to be never ending. Additionally, Samsung’s lawyers have been claiming that by going after Samsung again and again, Apple is in reality trying to target Android.

Android continues to grow its market share in US

Although Apple is the top smartphone manufacturer in US, with 41.4 percent OEM (Original Equipment Manufacturer) market share, the other handset developers are gradually eating into its share.

According to the latest comScore report on smartphone subscriber market share in the US for March 2014, Android continues to be the leading smartphone platform in the country, with 52.2 percent platform market share. It is followed by iOS, which has a 41.4 percent market share.


And even though after Apple(OEM share 41%)  Samsung (OEM share 26%) is the most sold smartphone brand in US, its market size is still a lot less than of that of Apple. Hence looking at research data, it clear that Android devices collectively are a bigger threat to Apple than a single OEM alone. Does this mean that Apple should change its target from Samsung to Google?
